Studying and job
For all those who work alongside their studies, there are a number of things to consider, including insurance and BAföG.
Here are examples of types of employment:
Working student regulation: An assessment as a working student can be made if the focus is on the studies and the employment is regularly carried out for no more than 20 hours per week.
Marginal employment: Possible for income up to the statutory mini-job earnings limit.
Short-term employment: Temporary employment, maximum three months or 70 working days in a calendar year with regularly more than 20 hours per week.
Employment subject to compulsory insurance: If the time scope of the working student regulation is exceeded and more than 20 hours per week are worked for a total of more than 26 weeks in the calendar year.
Self-employment: Some typical student jobs are handled in this way and you receive a fee instead of a wage (e.g. at events). With this type of employment, it is important for the health insurance companies to note that the focus is on your studies and that the self-employed or commercial activity is not considered “professional”, because then the voluntary health insurance for the self-employed would apply. In any case, you should speak to your health insurance provider to clarify how it will be classified. On the other hand, self-employed persons are obliged to submit an income tax return. For tax purposes and for BAföG (income limit differs; see below!), only the profit is of interest, i.e. the amount that results after deduction of all operating costs (collect receipts!).
If you work alongside your studies, you should always observe the income limits so that other benefits are not reduced or discontinued.
If you receive BAföG, you are allowed to earn additional income without deductions within the specified allowances. If the allowances are exceeded, BAföG will be reduced proportionately. Changes in income must always be reported to the BAföG office, otherwise repayments may be demanded. There are additional allowances for children and spouses (taking into account their own income) of students.
- In the case of non-self-employment within the approval period (term of the BAföG notification), a mini-job is not taken into account.
- Income from self-employment is calculated separately. The decisive factor here is the operating profit, i.e. the surplus of income over expenditure. One problem with the calculation: the approval period does not correspond to the tax assessment period (usually the calendar year).
- The allowances do not apply to internship semesters and mandatory internships.
In the case of family health insurance for people who are in training and under 25 years of age, or as a spouse, the monthly income is limited to the earnings limit of a mini-job. Short-term employment with higher earnings is possible (the health insurance funds can provide information here).
Employees’ rights also apply to part-time employment (which also includes marginal employment):
- Vacation entitlement
- Continued payment of remuneration in the event of illness
- Entitlement to special payments (note: under certain circumstances, special payments may exceed the marginal earnings threshold or be offset against BAföG benefits)
- Coverage in the statutory accident insurance
